Shall The Englewood Municipal Code of the City of Englewood, Colorado be amended to include official designation of Park property within the City of Englewood in order to protect the people of Englewood and their right to vote on the sale of Park property by: designating as “Park” any property identified on 2006 Englewood Parks and Recreation Master Plan as a Park including but not limited to:

 

Baker, Barde, Bates-Logan, Bellview, Centennial, Clarkson, Cushing, Depot, Duncan, Emerson, Hosanna, Jason, Miller Fields, Romans and Rotolo?

The People of Englewood have the Right to Vote on the Sale of Park Lands.

 

ARTICLE IX.  LEGAL DEPARTMENT  PART III.  MISCELLANEOUS LEGAL PROVISIONS

72:  Restrictions on sales and leases of land and other real property.

 

Lands granted to or purchased by the City for park purposes, and so dedicated, shall not be sold or conveyed without majority vote of the electors voting thereon at any general or special election, subject to the limitations contained in Section 14 hereof. Nothing in this provision shall be so construed as to prevent the City from selling or conveying, as hereinafter provided, lands purchased for purposes other than parks and not so dedicated, even though such lands may be used for park purposes. Real property of the City may be sold, subject to the restrictions contained in Sections 72 and 121 of this Charter without a vote of the electors, but only by ordinance, enacted, not using the emergency provision. Real property of the City may be leased, provided that no lease of any real property shall exceed a period of twenty (20) years, except leases to other municipalities or governmental agencies, or leases approved by a vote of the electors at any general or special election, subject to the limitations contained in Section 14 hereof.

How/Why SAVE Englewood Parks got started: June 2013:

The City Council claims it can sell Depot Park to a private business because it was never "dedicated" the same legal loophole being used in Denver to deny voters their rights.Depot park has been mainatined with Park and Recreation funds and appears on the on the 2006 Parks and Recreation Master PlanThe 2006 Report states, "Due to its strategic location on Dartmouth Avenue and near Santa Fe Drive, it is a valuable parcel of land owned and managed by the Parks and Recreation Department."Now, 7 years later, the City Council is selling this valuable Park Land FOR ONLY $30 THOUSAND DOLLARSto a business associate of ex-councilman Ray Tomasso, whose wife Diane Tomasso is a partner in this venture.Cultural Arts Minutes:Apr 3, 2013 ... Mr. Parsons reported that he has two people that he is working with who are major resources for preservation of the building, Diane Tomasso, ...It is important to get all our Parks "offically dedicated" to stop them from selling off our city parks.
